Remember the joke about the drunk who looks for his lost keys under the streetlight, rather than back in the dark alley where he dropped them, because the light is better?

Glenn Beck purports to fuse entertainment and enlightenment. He's providing some great television as he investigates ACORN. (Beck was accused by ACORN national spokesman Scott Levenson of being "afraid of black people" and he quickly began to vigorously promote the ACORN 8, led by DC ACORN chapter president Marcel Reid, in its campaign against those in control of ACORN for control of ACORN.)

But Beck's missed or disregarded the biggest story: illicit coordination between ACORN and the Obama campaign and The New York Times spiking an expose about it before the last presidential election.

That merits the fullest inspection, whether before or after election day.

Unlike Bill O'Reilly, who thinks of President Obama as a pragmatist who took a Far Left path to the White House, Beck appreciates that President Obama really embraces the Far Left agenda. But, when it comes to asserting wrongdoing, Beck too is leery.

Beck: "I'm not implying that Barack Obama is involved in this at all."

BULLETIN FOR BECK: AS ACORN WHISTLEBLOWER ANITA MONCRIEF ANNOUNCED ON "THE O'REILLY FACTOR," ACORN HAS BEEN FUNCTIONING AS "AN UNOFFICIAL ARM OF THE DEMOCRATIC PARTY" AND IT IMPROPERLY COORDINATED WITH THE OBAMA PRESIDENTIAL CAMPAIGN. Beck's much trumpeted one-hour special on ACORN broadcast on June 4, 2009 consisted of reruns of parts of prior programs relating to ACORN.

Nothing new.

Nothing on the scandal of The New York Times killing an ACORN/Obama campaign expose last October, lest the voters learn the truth and not elect Obama, or what the expose would have exposed.

In A Few Good Men (1992), a movie about a murder in a United States Marine Corps unit, Jack Nicholson, in the role of Col. Nathan R. Jessep, for which he received an Academy Award nomination, exclaimed, "You can't handle the truth!" in the courtroom scene.

Who CAN handle the WHOLE truth about ACORN, President Obama and the Obama presidential campaign?

ACORN whistleblower Anita MonCrief and attorney Heather Heidelbaugh have proven that they can.

Michelle Malkin definitely has proven that she can too.

The people controlling ACORN definitely can't.

The New York Times and the liberal media establishment definitely can't.

The Obama Administration definitely can't.

Can Beck?

Maybe, but he hasn't proven it yet.

Apparently not the group for which Beck has been trying to raise funds and find free legal services, the ACORN 8, the dissident group fighting for control of ACORN.

The ACORN 8 have not proven it either (as exemplified by their refusal to post the Kingsley report on ACORN's legal vulnerability on their website).

Last October The New York Times killed an ACORN/Obama campaign expose, lest Times choice Obama lose the election.

The Times had been ignoring the story completely, even after Ms. Heidelbaugh (for whom Ms. MonCrief had been a witness in a Pennsylvania ACORN voter registration fraud last October) testified about it at a House Judiciary subcommittee last March and House Judiciary Committee Chairman John Conyers (D--Mich.) called for a Congressional investigation of ACORN (which ACORN ally Congressman Jerrold Nadler (D.-N.Y.) stopped before it started).

The TimesNew York Times national correspondent Stephanie Strom told ACORN whistleblower and former Strom confidential source Anita MonCrief that she would not be coming to Washington, D.C. to meet with Ms. MonCrief and pick up documents as planned because she had been told by "higher up" that she had to "stand down."

But then Ms. MonCrief went public, beginning last Mother's Day. She's been interviewed by both Eric Shawn and Megyn Kelly of Fox News and, with Matthew Vadum of Capital Research Center, by G. Gordon Liddy on his radio program.

The result the next weekend: New York Times Apologist (officially, Public Editor) Clark Hoyt put out a column intended to dismiss the ACORN/Obama campaign story that had been spiked as "nonsense" and to disparage O'Reilly for temerity in the first degree by focusing on undisclosed tape editing and minor misstatements.

O'Reilly responded the next day by declaring war on The New York Times and interviewing Ms. MonCrief and Ms. Heidelbaugh, who demonstrated that O'Reilly had been essentially right.

Importantly, during that interview Ms. MonCrief twice called attention to "a smoking gun"--the Kingsley report, a 14 page memorandum prepared for ACORN by attorney Elizabeth Kingsley.

The Kingsley report was the subject of Ms. Strom's last article on ACORN, published on October 21, 2009, and the official excuse for The Times decision not to pursue the ACORN/Obama campaign story.

Predictably, ACORN attacked that Strom article as misleading, but the real problem with the article was what it left out, not what it included.

Ms. MonCrief told the world that she had read the Kingsley report and was working with Ms. Reid toward having it made available to the public.

But the ACORN 8 are not letting the public read the Kingsley report.

The ACORN 8 have a website--www.acorn-8.net. On it is posted what is called a Justice Department Complaint. (Actually, it is a complaint BY the ACORN 8 TO the United States Justice Department, not a complaint by the United States Justice Department.) That complaint refers the Justice Department to the Kingsley report.

The Kingsley report should be posted immediately on the ACORN 8, O'Reilly and Beck websites.

If the ACORN 8 really want truth, transparency and reform instead of only to control ACORN themselves, surely it would be posted.

Instead of posting it, the ACORN 8 issued a statement calling for a boycott of ACORN and had Beck publicly call on lawyers to donate services to the ACORN 8 and viewers to support it financially. (Beck has taken to calling Ms. Reid "Rosa Parks," and time will tell whether that is fair or foolish.)

A cautionary message to Beck and prospective donors: First read the Kingsley report. THEN decide what is best for you to do.

In "ACORN 8's Dilemma,' posted on February 2, 2009, I wrote:

"The ACORN 8 have a noble goal, but will they dare to do what is necessary to attain it?

"Then I went to the ACORN 8 website (www.acorn8.org), the following message greeted me:

'Thank you for coming to the ACORN 8 website. It's a work in progress, and you'll undoubtedly notice lots of new information and features appearing over the coming days and weeks, so be sure to check back often.

'In the meantime, let's talk for a moment about what we are and are not. We've recently heard a lot of confusion regarding our purpose, and part of the reason we started this website is to clear it up.

'ACORN 8’s purpose is simple: reforming the community activist group known as ACORN. We're not here to participate in rhetoric or mudslinging. Our one and only goal is to stop the systematic fraud and corruption going on inside the leadership of ACORN.

"Why does a good cause--fixing ACORN--attract so little attention?

"Perhaps because the ACORN 8 have not provided enough truth and transparency themselves.

"The first sentence of Ms. MonCrief's latest blog reads: 'If it were a movie, the title would read ACORN Part IV: The Payoff.'

"Ms. MonCrief's first version of that petition spoke of stopping a 'payoff' to ACORN, not 'funding,' and Ms. Reid and two others signed that version of the petition.

"'Payoff' is a loaded word, but it seems to me to be the right word.

"ACORN IS expecting a payoff from the Obama campaign and Congressional Democrats.

"ACORN delivered big time for them.

"And President Obama lied about his relationship with ACORN, even during the third presidential debate.

Time for the ACORN 8 to produce the Kingsley report, unredacted, and tell Beck the whole truth, despite their Obama and Democrat loyalties and Far Left views...or Beck to interview Ms. MonCrief and hear it from her.

Biography - Michael J. Gaynor

Michael J. Gaynor has been practicing law in New York since 1973. A former partner at Fulton, Duncombe & Rowe and Gaynor & Bass, he is a solo practitioner admitted to practice in New York state and federal courts and an Association of the Bar of the City of New York member.

Gaynor graduated magna cum laude, with Honors in Social Science, from Hofstra University's New College, and received his J.D. degree from St. John's Law School, where he won the American Jurisprudence Award in Evidence and served as an editor of the Law Review and the St. Thomas More Institute for Legal Research.
